The Zoning Board of Appeals (ZBA) consists of 5 members appointed by the Village Mayor. The main purpose of a Zoning Board is to entertain applications such as Building-Department denials where applicants are seeking relief from certain zoning codes, special permits, usage and area variances.
When an applicant files an application, it is processed and scheduled for a public hearing. The applicant is given a notice to send to surrounding property owners. The applicant must also post a public notice sign on the subject parcel. At the time of the hearing, the applicant should be prepared to present her/his case to the Zoning Board of Appeals. Village residents will be given time to speak on behalf or against an application. The applicant will be given the chance to rebut any testimony from objecting parties.
The Zoning Board of Appeals takes many factors into consideration when making a decision, including conformity to surrounding areas, impact on the environment and benefit to the applicant. These factors are then weighed against the detriment to the health, safety and welfare of the community before a decision is rendered.
